Overview

The TCPA is the US federal law that covers marketing texts. During setup, Cobalt asks you to confirm that it requires prior express written consent before your business sends marketing texts, including to customers whose numbers you collected before joining Cobalt. Your agreement with Cobalt says you are responsible for the consent behind every message you send.

What setup asks you to do

In the TCPA overview step during onboarding, you can play a short series of slides about consent, opt-outs, quiet hours and record keeping. Playing them is optional. To continue, you check this confirmation: "I watched the compliance overview and understand that the TCPA requires prior express written consent before my business sends marketing texts. That includes customers whose phone numbers I collected before joining Cobalt - I will not message anyone who has not opted in."

What Cobalt does to help

  • Consent records: Cobalt records each opt-in with the wording the person agreed to, when it happened and where. This covers popups, web forms, checkout, keywords and imports.

  • Opt-outs: STOP and similar words stop messages automatically.

  • Sending hours: Campaign and flow messages are held outside the sending window in the subscriber's local time.

  • Imports: When you import a list, you certify that the subscribers were collected through a compliant opt-in.

  • Hosted terms: Cobalt hosts Messaging Terms and a Privacy Policy page for your business that you can link from your website.

Helpful Information

Cobalt's tools help you keep records, but the consent itself is your responsibility.
